Terms for sellers and vendors on DaaBIN Auctions.

Introduction to Our Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and DaaBIN Auctions. They govern your access to and use of our website, mobile applications, and all other products and services we offer (collectively, the “DaaBIN Auctions Platform”). When we use the terms “DaaBIN Auctions,” “we,” “us,” or “our,” we are referring to DaaBIN Auctions and its applicable affiliated entities.

By accessing or using the DaaBIN Auctions Platform, you agree to be bound by these Terms and all policies incorporated herein by reference.

How the Platform Works

The DaaBIN Auctions Platform enables users (“Members”) to browse, bid on, win, pay for, and pick up items at designated location identified in the individual auctions.

Buyers and Sellers: Members who place bids and purchase items are referred to as “Bidders” or “Buyers.” Members who list items for auction are referred to as “Sellers.”

Auction Items: Items offered on the platform are sold through timed online auctions. These may include consumer goods, returned or overstock merchandise, estate assets, offsite assets, and other product categories (“Auction Items”).

If you are the winning bidder of an auction you will be notified via email and the credit card you have on file with DaaBIN Auctions will be charged immediately.  In the event the card on file is unable to be charged, you have 48 hours to complete your purchase by another means or your purchase will be considered abandoned and your account may be terminated.

All bids are final and bidders are prohibited from fraudulent bidding schemes or behaviors including but not limited to:

Bidding without the intent to pay

The use of bots or automation tools

Collusion bids or bid manipulation from 2 or more parties with the intent of increasing the price of the auction item.

Bidders caught exhibiting fraudulent behavior are subject to immediate account termination without notice.

Item Conditions and Disclaimers

Members acknowledge and agree that all Auction Items are used and may vary greatly in description, condition, and quality. Their exact state is not guaranteed.  It is the buyer’s responsibility to thoroughly examine the auction listing before placing a bid.

Subjective Descriptions: Any descriptions, ratings, tags, or labels provided by Sellers are subjective and for convenience only. They should not be relied upon as exact, precise, or complete representations of the item.

Unique Inventory: Because of the unique nature of auction inventory, DaaBIN Auctions cannot guarantee the availability of multiple identical items. All bids should be placed with the understanding that duplicate items may not be offered, and replacements or repairs cannot be provided.

Content Views: The publication of any content on the DaaBIN Auctions Platform should not be construed as an endorsement by DaaBIN Auctions of the views expressed therein, nor a warranty or guarantee of any action or recommendation made by the author.

Our Role as a Selling Platform

As the provider of the DaaBIN Auctions Platform, DaaBIN Auctions acts strictly as a venue and service provider. We are not a party to the transactions between Buyers and Sellers.

We do not act as a broker, agent, or insurer.

We do not guarantee the condition, accuracy, or completeness of any listing.

Unless explicitly stated otherwise in our policies, we do not own or take title to the Auction Items listed by Sellers using our platform.

Third-Party Sellers on the Platform

Unless explicitly stated otherwise in our policies, DaaBIN Auctions does not own, take title to, or directly sell Auction Items listed by third-party Sellers. In these cases, the agreement to buy and sell is strictly between the Seller and the Bidder/Buyer.

Varying Policies: Third-party Sellers may operate under their own names, business hours, locations, pickup procedures, and special conditions. Buyers are responsible for carefully reviewing auction details—including Seller name, location, and pickup windows—before placing a bid.

Assumption of Risk: DaaBIN Auctions does not inspect, warrant, or control Auction Items or Seller conduct. Buyers acknowledge that all risks of dealing with Sellers (including compliance with pickup requirements, product safety, and Seller representations) rest solely with the Buyer and the Seller.

Limitation of Liability: DaaBIN Auctions expressly disclaims liability for any costs, expenses, handling, import/export issues, damages, injuries, or losses to products, people, or property that may occur during transactions with offsite auctions, estate sales, or third-party Sellers.

Pickup and Hazards: We have no responsibility or liability for risks associated with loading/unloading, damage to vehicles (e.g., scratches, overloading), delays, environmental hazards, or the conditions of third-party parking lots and pickup locations. Participation in these auctions—including those involving hazardous, large, heavy, or damaged items—is at the Buyer’s own risk.

(Note: Nothing in these Terms limits or waives any rights you may have under applicable consumer protection laws that cannot legally be waived by agreement.)

Account Verification and Bidding Requirements

To place a bid on any Auction Item on the DaaBIN Auctions Platform, Members must adhere to the following requirements and conditions:

Account Verification: You must have a verified DaaBIN Auctions account, be logged into your account at the time of bidding, and provide and maintain accurate, up-to-date personal information (including your legal name, email address, and phone number).

Mandatory Credit Card on File: Before placing any bid, you must have a valid credit card securely saved on file within your DaaBIN Auctions account.

Binding Contract: Placing a bid constitutes a legally binding contract between you and the Seller. If you are the winning bidder, you are legally obligated to complete the purchase of the item. Bids cannot be canceled or retracted.  Make sure you are 100% willing to purchase the product, at the price you entered, before placing your bid.

Automatic Payment for Winning Bids: By placing a bid, you explicitly agree and authorize DaaBIN Auctions to automatically charge your credit card on file for the full purchase amount, plus applicable tax, immediately at the close of the auction if you are the winning bidder.

Account Conduct: DaaBIN Auctions reserves the right to suspend, restrict, or deactivate accounts without notice if a user provides false or misleading information. Furthermore, creating multiple accounts by the same user is strictly prohibited and will result in a permanent ban and deactivation of all associated accounts without prior warning.

Bidding Responsibility: You are solely responsible for all bidding activity conducted through your DaaBIN Auctions account, regardless of whether the activity or specific bids were authorized by you.

Item Pickup and Abandonment Policy

Prompt and timely removal of purchased items is essential. By bidding on and winning an item on the DaaBIN Auctions Platform, you agree to the following pickup requirements and conditions:

10-Day Pickup Window: All winning Bidders must schedule and complete the physical pickup of their purchased Auction Items within ten (10) business days following the close of the auction.

Abandoned Property: If you fail to schedule and retrieve your item within the strictly enforced 10-business-day window, the item will be officially deemed abandoned.

Reversion of Ownership: Once an item is classified as abandoned, the Buyer immediately forfeits all rights, title, and interest to that item. Ownership of the abandoned property automatically reverts to the Seller. The Seller or DaaBIN Auctions reserves the right to resell, dispose of, or otherwise manage the item at their sole discretion without further notice to you.

No Refunds for Abandoned Items: Because winning bids are legally binding contracts and credit cards are automatically charged at the close of the auction, abandoning an item does not relieve you of your financial obligation. Buyers who fail to pick up their items within the required 10-day timeframe will not receive a refund, credit, or chargeback authorization for the abandoned property.

Tax Policy

DaaBIN Auctions collects sales tax in compliance with applicable state and local laws.

Automatic Calculation: Sales tax is automatically calculated and applied to your purchase at checkout. Rates are determined by the specific jurisdiction of the pickup or shipping location and may include state, county, and local taxes.

Taxable Amount: Taxes are calculated based on the total purchase price, which includes the final winning bid, the Buyer’s Premium, and any applicable service fees.

Tax Exemptions: Sales tax applies to all taxable Auction Items unless the Buyer provides a valid, approved tax exemption certificate prior to checkout.

Buyer Responsibility: Buyers are solely responsible for any additional taxes, duties, or reporting obligations not directly collected by DaaBIN Auctions.

Rate Changes and Errors: Jurisdictional tax rates are subject to change without notice. Any errors in the calculation or collection of taxes by DaaBIN Auctions do not relieve the Buyer of their legal obligation to pay applicable taxes.

Buyer’s Premium

A Buyer’s Premium is an additional percentage-based fee applied to the final winning bid of each Auction Item.

Standard Rate: The Buyer’s Premium is typically 15%, though this rate may vary depending on the specific auction event.

Buyers who are subscribed to the Premium Membership program will receive a 15% discount at checkout, offsetting the buyer’s premium.

Transparency: The applicable premium percentage is clearly displayed on every Auction Item listing and will be included in your cart total before checkout.

Tax Implications: The Buyer’s Premium is legally considered part of the total purchase price and is therefore subject to applicable sales tax.

Overtime Bid Extension

To maintain a fair bidding platform, if a bidder places a bid within the last 1 minute of the auction, the auction is extended for an additional 1 minute.  Overtime Bid Extension will repeat indefinitely until no new bids are placed in the last 1 minutes and the auction is won by the highest bidder.

Proxy Bidding

Users may authorize a predetermined ceiling price for any specific auction item. The DaaBIN Auctions platform subsequently executes automatic offers on the user’s behalf. These automatic advances progress exclusively in standardized intervals set by the auction owner, solely to the extent required to maintain the user’s status as the prevailing participant.

Authorized ceiling prices remain strictly private and are entirely concealed from competing participants. DaaBIN Auctions disclaims all liability for unexecuted offers stemming from software anomalies, network instability, or broader internet infrastructure disruptions.

In circumstances where multiple participants authorize the exact same ceiling price, prevailing status is unconditionally awarded to the chronologically prior submission.

Communication Consent

By creating and using a DaaBIN Auctions account, you expressly consent to receive communications necessary for to conduct business on DaaBIN Auctions.  Your activities relating to account management, auction participation, and order fulfillment will result in communication from DaaBIN Auctions. These communications may be delivered via email or SMS text messages.

Mandatory Transactional Communications:

Certain messages are required to successfully fulfill your orders and manage your account. Because these are a condition of using the DaaBIN Auctions Platform, they cannot be disabled without permanently closing your account. Mandatory communications may include:

  • Receipts and invoices for won Auction Items.
  • Payment receipts and confirmations.
  • Pickup instructions, appointment booking confirmations, and missed-appointment reminders.
  • Cart-expiration notices and order-issue alerts (e.g., missing or removed inventory).
  • Important policy updates or account security alerts.
  • Optional Communications
  • You have the ability to opt out of or manage your preferences for non-essential communications within the Communication Preferences section of your account. Optional communications include:
  • Outbid notifications and auction closing warnings.
  • Auction announcements and special offers.
  • Promotional messages and similar marketing alerts.

(Note: Opting out of optional promotional communications does not relieve you of any account, payment, or pickup obligations.)

User Responsibilities:

Consent to receive necessary communications is a condition of your account use and auction participation.

Accurate Information: You are strictly responsible for maintaining accurate and up-to-date contact information in your account profile.

Monitoring Channels: You are expected to monitor your registered communication channels for important updates regarding your bids and purchases.

Missed Communications: Failure to receive a communication due to incorrect contact information, carrier issues, spam filters, or user settings does not relieve you of any financial or pickup obligations under these Terms.

Modifications to These Terms

DaaBIN Auctions reserves the right to update or modify these Terms and incorporated policies at any time by posting revised versions on the platform.

You can determine when we last updated these Terms by checking the “Last Updated” legend at the top of the document.

Updated Terms are effective immediately upon posting.

Except where your express consent is required by law, your continued use of the platform constitutes your acceptance of the revised Terms. If you do not agree to any changes, you are not authorized to use the DaaBIN Auctions Platform.
